Property Statements without Values

"While working with a client, we attempt to ensure that everything we do is geared to provide a positive experience with the judicial system."

Our office has determined it would be inappropriate to include values in the initial Property Statement given that Property Statements must now be filed at the same time. Petitions are issued in accordance with the rules. To avoid having clients attest under oath to values for a to-be-determined date and having irrelevant values on court documents, we do not include values on Property Statements accompanying Petitions.

Once a Petition is issued, we send a request to our clients to collect the disclosure and values as of the date of the issued Petition to improve efficiency. 

We hope this does not cause inconveniences (in fact, we hope it improves the process). We anticipate our office will have a completed and more accurate Property Statement around the time or shortly after the opposing party has filed their materials which will allow for fruitful discussion and hopefully a quicker and more pain-free resolution.

  • Practice in Quebec: The NMA primarily applies to common law jurisdictions, and different rules may apply for practice in Quebec.
